This Privacy Policy (the “Policy”) applies to all users of our website and any software or services provided by Drafthorse Solutions, LLC (the “Company”, “we” or “us”), including our WORKHORSE workflow management application (the “Application”) and any other services offered or hosted by the Company (collectively, the “Services”). This Policy describes:


  • The types of information we may collect from you or that you may provide to us when you use our Services;

  • Our practices for collecting, using, maintaining, protecting, and disclosing that information;

  • Your choices about how we use information about you (including how you can access and update your information and your preferences); and

  • Information specific to the privacy rights and protections available by law to residents of the European Union (the “EU”).

Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with the policies and practices detailed herein, you must discontinue your use of our website and our Services immediately. By continuing to use our website or by accessing the Services, you consent to the terms of this Policy. 


This Policy applies only to information we collect through our website and through the Services, including emails, texts, and other electronic communications sent in connection with the Services (such as customer service or support requests). 


This Policy DOES NOT apply to information that you provide to a third party, or any information collected by a third party. Our website(s) and other applications and third parties operating other websites, applications or software may have their own privacy policies.


Users under the age of 18 are not permitted, and we do not knowingly collect personal information from children under the age of 18. By using our website or any of our Services, you represent to us that you are at least 18 years old. If we learn that we have collected or received personal information from a child under age 18, we will delete that information. Please notify us immediately if you believe that we have erroneously collected information from a child under age 18. 


Important information for European Economic Area users:


The data controller for personal information disclosed in connection with the use of our Services is Drafthorse Solutions, LLC. 


We undertake physical, technical and administrative safeguards to maintain the security and privacy of any personal information provided to us and direct our United States-based service providers to do the same; however, please be advised that the European Commission has not made an adequacy finding under the General Data Protection Regulation with respect to transfers of personal information to the United States and any personal information disclosed by you during your use of the Services may not be subject to the same legal safeguards that would apply to intra-European transfers of personal information.

What Information We Collect and How We Collect It


Information You Provide to Us


When you download, register with and/or use our Services, we may ask you to provide information that may be deemed “personal information” under applicable law, including: your name, address, e-mail address, phone number and company.


In addition, we may collect certain billing information when you purchase the Services. We do not retain or store credit card information. A third-party intermediary is used to manage credit card processing. This intermediary is not permitted to store, retain, or use your billing information for any purpose except for credit card processing on our behalf.


You may also upload certain information to our servers as part of your utilization of the Services. Under the terms of our End User License Agreement, no third-party personal information may be uploaded to our servers. If we become aware that any third-party personal information has been uploaded to our servers, you agree to comply with any request to delete this information. If you do not comply with our request, you agree that we are authorized to delete such information without any further consent or authorization from you.


Information We Collect About Your Use of the Services


We track data about all visitors and customers who use our Services and we log and store this information. These logs may contain IP address information, types of operating system you use, the date and time you visited the site, the features you use, the links you click on, search terms and files you view.


We may also collect information about your computer, phone, tablet or other devices you use to access the Services. This device information includes your connection type and settings when you install, access, update, or use our Services. In addition, we may collect information through your device about your operating system, browser type, IP address, URLs of referring/exit pages, device identifiers, and crash data.


Use of Cookies


Our website places “cookies” on your computer, phone, tablet or other devices to allow us to improve our Service’s functionality. The cookies do not contain any personally identifiable information.


What is a cookie? A cookie is a small data file that certain web sites write to your hard drive when you visit them. Your user id or profile information is not stored in cookies.

We use it in the aggregate as opposed to using any personally identifiable information, to understand how our users collectively use our Services, such as traffic patterns. This clues us in to the most popular destinations on our Services and what technologies are being used so that we can continually improve our Services.

How We Use Your Information


We use information that we collect from or about you, including your personal information to:


  • Provide you with the Services;

  • Notify you of other Services offered by the Company that may be of interest to you;

  • Carry out our obligations and enforce our rights with respect to any contracts between you and us;

  • Notify you when we make any updates or changes to the Services, our End User License Agreement or this Policy; and

  • Respond to law enforcement requests or to comply with legal requirements, as needed.

We may also use the Services usage information that we have collected to help deliver a more personalized experience to you. We may use this information to:  (a) estimate the number of users and usage patterns; (b) store information about your preferences, and use it to customize the Services to your needs; and (c) confirm your identity when you log in to use our Services.


We will store the information provided by you for as long as you maintain an Account with us and/or use our Services. We typically delete inactive Accounts and the information associated with such Accounts if they are inactive for sixty (60) days.


Legal Bases for Processing (for EEA users):


If you are an individual in the EEA, we collect and process information about you only where we have legal bases for doing so under applicable EU laws. The legal bases depend on the Services you use and how you use them. This means we collect and use your information only where:


  • We need it to provide you the Services, including to operate the Services, provide customer support and personalized features and to protect the safety and security of the Services;

  • It satisfies a legitimate interest (which is not overridden by your data protection interests) (a) for research and development, (b) to market and promote the Services or (c) to protect our legal rights and interests;

  • You give us consent to do so for a specific purpose; or

  • We need to process your data to comply with a legal obligation.

If you have consented to our use of information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any processing that has already taken place.  Where we are using your information because we or a third party have a legitimate interest to do so, you have the right to object to that use though, in some cases, this may mean no longer using the Services.

We may disclose aggregated information about our users which does not individually identify you or your device without any restrictions and without seeking any permission besides your consent to this Policy. We may also disclose personal information about you that we collect or that you provide:


  • To contractors, service providers, and other third parties we use to support our business and who are contractually bound to keep personal information confidential and to use it only for the purposes for which we disclose it to them;

  • To anyone who buys, merges with or otherwise succeeds to the Company’s interests in the event of a merger or other sale or transfer of some or all of the Company’s assets, if such assets include personal information collected by us, whether as a going concern or in connection with a bankruptcy, liquidation or other similar proceeding;

  • To fulfill the purpose for which you provided it;

  • For any other purpose disclosed by us when you provide the information;

  • To comply with any court order, law, or legal process, including but not limited to responding to any government or regulatory request;

  • To enforce our rights arising from or under our End User License Agreement and any other contracts between you and us,  and for billing and collection, as applicable;

  • If we believe that disclosure is necessary or appropriate to protect the rights, property or safety of the Company, Our customers or others; or

  • Otherwise with your consent.

In the past 12 months, we have disclosed your personal information to our service providers strictly for the purposes of providing the Services to you.

Managing Your Personal Information


You may log in to your Account in order to view the personal information that we have on file for you, update or correct your personal information.  You may access your personal information, correct or remove it, or completely withdraw your consent for processing it at any time. We may request specific information from you to confirm your identity before completing any requests to process or delete your information. We reserve the right to retain such information as may be permitted under applicable law.


Changes to Our Privacy Policy


We may update the Policy from time to time in our sole discretion. If we make any material changes to how we treat our users’ personal information, we will notify you by email sent to the primary email address specified in your Account and by posting our updated Policy on our website, with an updated effective date noted on the Policy. Your continued use of the Services following the posting of changes constitutes your acceptance of such changes.
